Was Nilo ‘Rando’ Bertoia’s release refused on a technicality? 

At the time of his arrest on the 11th June 1940, he had been resident in the UK for only 19 years and 11 months.

Category 22. Any person as to whom the Tribunal, appointed by the Secretary of State, reported that he had, since childhood or for at least 20 years, lived continuously or almost continuously in Great Britain...

Rando returned to the UK on the 23rd September 1945.
